Mailchimp Addon and CASL

On July 1 the Canadian Anti-Spam Law came into effect. The Mailchimp addon for EE4 makes it impossible to follow this law.

The law requires consent but double opt-in is not adequate.

This must be (by the law) achieved by adding a tick box with a message confirming consent.

EG: [ x ] Yes, I consent to this subscription. (Required by law this can not be pre-selected)

The questions functionality allows us to add the “tick box” but whether selected or not the subscription goes through.

Best practices suggest express consent makes for a healthier list and more engaged subscribers.

If we make use of the addon as it is we could face a fine of up to CA$3 million if we were reported.

Is there a solution that makes this important addon legal in Canada (and to those sending email to Canada)?

Hi,

A checkbox option is not currently available for the opt-in. However, no attendees/registrants are added until they actually click the opt-in confirmation email from MailChimp.

Are you seeing something different?

Hi, I’ve created a report for the development team to review.

However, the integration should now add any members to an actual list until they have confirmed via email with MailChimp.

Let us know if you are seeing something different.

I tried to be as clear as possible.

1. Double opt-in is NOT adequate. In other words, you can not get consent by email confirmation from MailChimp.

It is illegal to send an email to someone without their consent. That includes an email requesting consent.

So, to be clear, the MailChimp confirmation email is illegal. We need consent to send that email. Which means we need to ask up front and then send an email.

Gravity Forms does this very well but there’s no way to use their solution during checkout when we’re most likely to get folks to subscribe.
